Terms and Conditions
- The Promotion
These terms and conditions and the entry details govern the Zurich Win a pair of Ray-Ban Meta Wayfarer sunglasses Trade Stand competition (“Promotion”). By entering the Promotion, you acknowledge that you have read and agree to these terms and conditions, including the Privacy Notice at clause 18.
The Promotion will commence on the Start Date and close on the End Date (“Promotion Period”).
Eligibility
The Promotion is open to Australian residents aged 18 or over that meet the following criteria:
- The individual must not be a director, employee, contractor (or their immediate family) of the Promoter or its related bodies corporate (each, an “Entrant”)
- The Prizes
- A Prize is not exchangeable, transferable or redeemable for cash or other goods or services.
- The total value of the Prizes is AUD $392 inclusive of GST.
- No bonus prizes will be awarded.
- It is a condition of accepting the Prize that the Winner must comply with all the conditions of the Prize.
- Participating in the Promotion
- An Entrant can enter the Promotion by visiting the Zurich trade stand during the Ausure Conference and use the entry form to provide their contact details requested by the Promoter, during the Promotion Period.
- An Entrant is permitted to enter the Promotion once.
- Any entry not in compliance with these terms and conditions is automatically invalid. The Promoter reserves the right to accept or reject non-compliant or incomplete, indecipherable or illegible entries in its sole discretion.
- An Entrant or purported Entrant will be disqualified from the Promotion, and will not be eligible for any Prize, if they:
- enter the Promotion without being eligible under clause 2; or
- submit an entry that does not comply with these terms and conditions.
- The Draws
- The Promoter will randomly draw the winners of the Promotion (each, a “Winner” and collectively, the “Winners”) from the pool of valid entries made by Entrants during the Promotion Period by random using the Random.org True Random Number Service (“Draw”).
- Each of the Draws will take place at the Draw Location on the Draw Date.
- Each valid entry in the Draws will have an equal chance of being drawn.
- A Winner may only win a total of one of the Prizes.
- If the Promotion involves more than one Prize, the Prizes will be drawn in order of their value.
- For the avoidance of doubt, the Promotion will not involve an elimination round.
Notification of Winners
Within 7 days after the relevant Draw, the Winners will be notified in writing (via the contact details provided by the Winners to the Promoter) and informed of how the Prize will be delivered to them. At the Promoter’s discretion, the Promoter may notify a Winner in person at the Draw Location instead of notifying them in writing.Announcement of Winners
Within 7 days after each relevant Draw, the Promoter will announce the Winners via brokers.zurich.com.au/comp-winners. The Winners will remain visible for a period of at least 28 days.Prize distribution
- The Winners will be delivered the Prize within 14 days after each relevant Draw.
- There will be no cost to the Winners associated with accepting a Prize.
- At the Promoter’s discretion, a Prize may be hand-delivered to a Winner at the Draw Location in lieu of the method specified in clause 8(a).
Prize substitution
If the Prizes are unavailable or become unavailable through no fault of the Promoter after the commencement of the Promotion, the Promoter may, subject to applicable laws, substitute the Prize with a substitute prize, provided that the substitute prize is of the same or greater value and specification as the Prize. The Promoter will use reasonable efforts to reach an agreement with the Winner on the substitute prize.
Rejection of a Prize
- A Winner may opt to reject the Prize within 14 days after notification of winning by contacting the Promoter by phone or email (see clause 19).
- In the event that a Winner rejects a Prize in accordance with clause 10(a), the Promoter may redraw the Prize in accordance with clause 12.
Unclaimed Prize
- If a Prize is not able to be sent to a Winner through no fault of the Promoter within a period of 3 months after the Draw Date (“Claim Period”) the Prize will be deemed forfeited, the Promoter will provide notice of this fact via brokers.zurich.com.au/comp-winners and the Promoter may redraw the Prize in accordance with clause 12.
- The Promoter will make every reasonable effort to contact the Winner during the Claim Period using the contact details provided by the Winner.
Redraw
In the event that a Prize is rejected in accordance with clause 10(a) or unclaimed in accordance with clause 11, a second draw for that Prize (“Redraw”) will take place on the Redraw Date at Level 25, 118 Mount St, North Sydney, and the Redraw will be deemed a Draw and the Redraw Date will be deemed the Draw Date for the purposes of clauses 5, 11 and 15 of these terms and conditions.Promotion
- The Winners consent to the Promoter, without royalty or any fees, using his or her name, likeness, image, voice and entry in any marketing and promotion of the Promoter, including in accordance with clause 7.
- The Winners may be required to participate in media activity and sign a release and consent form if requested by the Promoter.
Disputes
Decisions of the Promoter in relation to the Promotion, including any disputes concerning the conduct of the Promotion or claiming a Prize are final and may be made in the Promoter’s sole discretion, having regard to the spirit of the Promotion and applicable laws.Termination of the Promotion
- The Promoter may terminate the Promotion at any time and for any reason without liability prior to the Draw Date, subject to applicable laws.
- If the Promoter terminates the Promotion prior to the Draw Date, then the Promoter will not proceed to conduct the Draw and no Entrant or other person will be eligible to win any Prize under the Promotion.
Liability
- Subject to clauses 16(b) and 16(c), the Promoter is not liable for any loss, cost, expense, damage or liability suffered or incurred by any Entrant or any Winner in connection with the Promotion, including in connection with:
- late, lost, altered, damaged or misdirected entries or Prize acceptance, including delays due to technical disruptions or network congestion;
- any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Promotion;
- any theft, destruction, unauthorised access to or alteration of entries; or
- any use of a Prize or any tax liability incurred by Winners as a result of winning or accepting the Prizes.
- Nothing under clause (a) limits any Entrant’s or Winner’s rights under the Competition and Consumer Act 2010 (Cth) (“CCA”).
- These terms and conditions do not exclude or limit the application of any statutory provision, including but not limited to a provision of the CCA and the consumer guarantees under the Australian Consumer Law, where to do so would contravene that statute or cause any part of these terms and conditions to be void.
- Subject to clauses 16(b) and 16(c), the Promoter is not liable for any loss, cost, expense, damage or liability suffered or incurred by any Entrant or any Winner in connection with the Promotion, including in connection with:
- Force majeure
Without limiting clause 15, if the Promotion is unable to proceed due to unforeseen circumstances, including cyber-attack, industrial strike, computer virus, fraud, or technical failures, the Promoter may take appropriate action with respect to the Promotion (including suspension, termination or modification of the Promotion) as it deems appropriate, subject to any relevant regulation or law or direction from a regulatory authority. The Promoter will collect personal information directly from each Entrant to conduct the Promotion, provide its services (including marketing and promotion where consent has been given) and comply with its legal obligations. If an Entrant does not provide the requested personal information, they will not be able to participate. Changes to these terms and conditions
The Promoter reserves the right to vary these terms and conditions for the purpose of facilitating the efficient and effective operation of the Promotion, subject to applicable laws. If the terms and conditions are varied in accordance with this clause, the Promoter will publish the updated terms and conditions as soon as possible
Governing law
These terms and conditions are governed by the laws of New South Wales and the Entrants submit to the jurisdiction of the courts of New South Wales in respect of any proceedings in connection with these terms and conditions.
